The use of the www.visilab.ch website is subject to these General Terms and Conditions of Use of the VISILAB website. VISILAB reserves the right to modify these terms and conditions at any time. The modified terms and conditions take effect on the date of their publication on the www.visilab.ch website for all users.
All users of the www.visilab.ch website expressly acknowledge that they have read and fully accepted these General Terms and Conditions of Use.
Intellectual property
The www.visilab.ch website and all its contents, in particular the graphic and textual elements, are the exclusive property of VISILABGROUP SA.
Any reproduction and/or use of all or part of the components subject to intellectual property rights, in particular the texts, images, brands and logos that feature on the site, is subject to the express prior authorisation of VISILABGROUP SA.

A copy of the identity document must be attached to the request in order to confirm the identity of the applicant.
The user confirms that the data provided is accurate and complete. If the data is inaccurate, the customer may send a letter by post at any time to request its rectification in accordance with Art. 5 FADP.
Duration of retention of personal data
Under various cantonal laws (e.g. cantonal health laws) and federal laws (e.g. the retention of accounting records and vouchers under Art. 958f para. 1 CO), VisilabGroup AG is obliged to store certain specific data such as medical, accounting and personal data relating to the performance of a contract for a period of at least 10 years.
Protection of personal data and transfer to third parties
The customer is informed that their personal data will be processed by VisilabGroup AG in accordance with Swiss data protection legislation. For certain data processing operations, Visilab may commission third parties who are bound by the same legislation and principles of confidentiality. VisilabGroup SA takes all the necessary technical and organisational measures to ensure the confidentiality of its customers’ personal data and to protect this data against unauthorised access. The security measures applied by the VisilabGroup SA are constantly adapted to take account of the latest technological developments.
Cookies
VISILABGROUP SA reserves the right to send cookies to the user’s computer when the user connects to and browses the www.visilab.ch website. The user can prevent cookies from being stored on their computer by configuring their browser accordingly.
General terms and conditions of use of the virtual fitting service
In addition to the above General Terms and Conditions of Use of the Visilab website, these General Terms and Conditions of Use apply between VISILAB and any Internet user (hereinafter referred to as the “USER”) wishing to use the services described in these General Terms and Conditions.
1- The Service
The VISILAB website, published by VISILAB, offers an online virtual glasses fitting service (hereinafter referred to as the “Service”), which is based on a photograph of a model’s face or on a photograph of the USER provided by the latter.
2- Access to the Service
The Service is exclusively available to natural persons for personal and strictly non-commercial use. Consequently, the USER guarantees that they belong to this category of persons. Access to the Service is free of charge and does not require registration.
3- Limitations of the Service
The Service allows the USER to obtain an idea of the way a pair of glasses will look. It does not guarantee the correspondence of the glasses with the real models, nor their suitability for the USER’s needs, nor does it guarantee that the impression of the glasses, as visualised via the Service, will be identical or similar to the real appearance.
4- Terms and Conditions of Use of the Service
The relationship between the USER and VISILAB is essentially governed by these General Terms and Conditions.
5- Price of the Service
The Service is offered and provided free of charge.
6- Role and general obligations of VISILAB
VISILAB undertakes to provide the Service in accordance with these General Terms and Conditions and guarantees that the Service will be provided 24 hours a day, 7 days a week, subject to unforeseen circumstances (technical issues, third-party events, force majeure, viruses, etc.) or maintenance operations carried out on the VISILAB website or on the Service. VISILAB reserves the right to stop providing the Service at any time and may refuse or withdraw access to the Service from a USER who has failed to comply with any of the provisions of these General Terms and Conditions.
7- Role and general obligations of the USER
a) The USER undertakes to provide VISILAB exclusively with photographs that represent the USER themselves. Under no circumstances should they upload photos of other people, even with the consent of the third party. This commitment is essential and the USER guarantees that the photographs uploaded are their own exclusive property.
b) The USER declares that they will not provide photographs via the Service whose nature, content or characteristics would be, even in part, contrary to Swiss law or any other foreign law to which they are subject, to public order and morality, or would be detrimental to the security and interests of Switzerland or any other country.
The USER shall in particular ensure that the information and photographs provided:
In no case infringe the rights of others, copyright, trademark rights or more generally any intellectual or industrial property rights held by a third party;
In no case infringe the regulations in force relating to the respect of privacy and the protection of personal data;
Do not include photographs or other content that is pornographic, paedophilic, defamatory or offensive, obscene, rebellious, violent, blasphemous, of a negationist nature or that is likely to incite racial hatred, an act of offence, a crime or an act of terrorism, or that condones war crimes or crimes against humanity, or that is likely to incite an individual to commit suicide;
Are decent and relate exclusively to the USER (this applies to photographs or other content originating from the USER);
Do not restrict, disorganise or prevent the use of all or part of the Service (viruses, Trojan horses, etc.).
c) If the USER is under the age of 18, they must have their parents’ authorisation to use the Service; this point is essential and decisive.
d) The USER undertakes to use the Service for personal and not for professional purposes. The USER gives VISILAB its full assurance in this regard.
e) In general, the USER guarantees VISILAB that their use of the Service will be in full compliance with the regulations in force. In the event of improper use, the USER shall bear the costs of defending VISILAB if a claim is brought against VISILAB by a third party or if legal proceedings are initiated against VISILAB by a third party in a civil court. Furthermore, the USER shall be liable for all costs and damages incurred by VISILAB in connection with the criminal and/or civil action.
8- Personal data
VISILAB declares that the USER’s personal data is processed in accordance with the provisions of Swiss data protection legislation, and in particular that personal data is only collected or processed to the extent necessary for the provision and management of the Service.
9- Ownership
All components of the VISILAB website (including components of the Service), whether visual or audio, including the underlying technology, are protected by law (copyright, trademark or patent law). They are the exclusive property of VISILAB or of the third party who has granted all or part of the rights to VISILAB for the purposes of providing the Service.
The USER does not acquire any right to these elements and is prohibited from reproducing, representing or counterfeiting them in any way and on any medium whatsoever.
10- Liability
The USER shall be held liable for any proven breach of any of the obligations set out in these terms and conditions. Consequently, the glasses presented by VISILAB for the purposes of the Service are made available in agreement with the owners of the rights to these glasses (manufacturers, brands, distributors, etc.). These persons can in no way be held responsible for the Service or for the glasses presented via the Service.
11- Duration and termination
These General Terms and Conditions apply for the duration of the online availability of the Service by VISILAB. The Service is provided during the period of consultation by the USER (time during which the USER is connected to the Service).
If the USER fails to comply with the rules in force, VISILAB may terminate the Service without notice or formal demand. Such termination shall not exempt the USER from their liability, and the USER shall therefore remain liable for any direct or indirect damages that may be claimed by VISILAB as a result of such breaches.
12- General provisions
a) If one or more of these clauses should be invalidated or annulled by the effect of a law or regulation, or if they should be declared as such by a final decision made by a competent court, the other clauses shall retain their force and scope.
b) The fact that a Party does not avail itself of a breach by the other Party of one of its obligations shall not be interpreted as a waiver of the obligation in question for the future.
c) Swiss law shall apply.
UNLESS OTHERWISE PROVIDED BY LAW, IN THE EVENT OF A DISPUTE CONCERNING THE EXECUTION OR INTERPRETATION OF THESE TERMS AND CONDITIONS, AND AFTER UNSUCCESSFULLY ATTEMPTING TO FIND AN AMICABLE SOLUTION, JURISDICTION IS EXPRESSLY ASSIGNED TO THE COMPETENT COURTS IN THE CANTON OF GENEVA, NOTWITHSTANDING PLURALITY OF DEFENDANTS, EXCEPT IN CASES THAT MAY BE BROUGHT BEFORE THE SWISS FEDERAL COURT.

Legal notice - MyVisilab
MyVisilab is an area accessible to all Internet users visiting the visilab.ch site.
The data on the MyVisilab site is information that has been communicated by the customer to Visilab.
You will find in your space the history of your purchases since March 2014. Thereafter, all purchases will be stored in MyVisilab.
Creating an account
You must first create an account on the website www.visilab.ch/myvisilab.
In order to create your account, you must fill in the following information: title, first name, last name, e-mail address and a password. You must enter your e-mail address for your next login.
Then, if you are a Visilab customer, you can link your customer ID, i.e. a customer number from your invoices, to this account in order to retrieve your invoices.
After entering the customer ID, an activation code will be sent to your e-mail address or telephone number previously communicated to Visilab. If we have both means of communication, the activation code will be sent to your default e-mail address.
If we do not have an e-mail address or telephone number, please visit your local Visilab shop.
A maximum of 4 hours is necessary between the creation of your account and the availability of your personal data.
MyVisilab homepage
The shop linked to your MyVisilab space is the shop where you made your last purchase. Visilab allows itself to merge your accounts if you are a customer in several shops. This implies that, if the merging has been done, you will find in your space, the history of purchases made in different shops. If you do not want Visilab to merge your accounts, please contact us at support.client@visilab.ch
The fields: title, surname, first name, email address are mandatory in MyVisilab.
You have the right to access and modify your personal data related to a shop.
Visilab will not pass on your personal information to third parties without your prior consent, except in the context of computer processing carried out on behalf of Visilab and in compliance with Swiss data protection legislation.
You will also find the services to which you have subscribed.
My purchases
Under the heading: my purchases, you will find the invoices for your last purchases from 1 March 2014. They will be kept for a period of 10 years.
